Trump Asks Supreme Court to Allow Mail Voting Restrictions Before Midterm Elections

President Donald Trump's administration has asked the U.S. Supreme Court to allow key parts of his executive order restricting mail-in voting to take effect ahead of the November 2026 midterm elections, escalating a legal battle over federal authority and election administration.
The emergency appeal comes after lower federal courts blocked the order in 23 Democratic-led states and the District of Columbia, ruling that the president likely exceeded his constitutional authority by attempting to reshape election rules through executive action rather than legislation.
Administration Seeks Immediate Supreme Court Intervention
The Justice Department argues that the Supreme Court should lift the injunction so election officials have time to implement the administration's policies before this year's congressional elections.
The executive order, signed in March, directs federal agencies to create a state-by-state citizenship list intended to verify voter eligibility for mail ballots. It also instructs the U.S. Postal Service to introduce new ballot-handling requirements, including standardized barcoded envelopes, and warns that states refusing to comply could risk losing certain federal election funding.
Administration lawyers argue the states challenging the order lack legal standing and describe the measures as lawful guidance designed to protect election integrity.
States Say Trump Exceeded Presidential Authority
A coalition of Democratic attorneys general argues that the U.S. Constitution gives states primary responsibility for administering elections, while Congress—not the president—has authority to establish nationwide election rules.
The lawsuit contends that Trump's executive order unlawfully attempts to impose federal voting requirements without congressional approval and would significantly disrupt election preparations already underway.
Earlier this month, the 1st U.S. Circuit Court of Appeals upheld a lower court injunction blocking the executive order in the affected states, finding that the challengers were likely to succeed in arguing the order exceeded presidential authority.
Mail Voting Again at the Center of National Debate
The case returns mail-in voting to the center of America's political debate ahead of the midterm elections.
President Trump has repeatedly argued that tighter voting procedures are necessary to strengthen election security and public confidence. Critics counter that the proposed restrictions could make voting more difficult for eligible voters and interfere with long-established state election systems.
The administration is asking the justices to act quickly, saying states need certainty before election preparations enter their final stages. The coalition challenging the order has until August 3 to file its response.
Supreme Court Faces Another Major Election Case
The appeal is the latest in a series of election-related disputes reaching the Supreme Court before the November elections.
Earlier this year, the Court declined to overturn a Mississippi law allowing certain timely postmarked mail ballots to be counted after Election Day, underscoring the continuing legal debate over mail voting rules across the United States.
The justices have not indicated when they will rule on the administration's emergency request, but the decision could significantly influence how mail voting is administered in much of the country during the 2026 midterm elections.
