Election Commission is a constitutional body, Supreme Court cannot interfere

Chief Justice of Pakistan Qazi Faiz Isa remarked during the hearing on the Election Commission's petition against the Peshawar High Court's decision to restore the bat sign that the order of the High Court will have to be suspended to adjourn the hearing till Monday.



They are ready for hearing on Saturday and Sunday also, Election Commission is a separate constitutional body, they will not do the work of a constitutional body by themselves, it is the responsibility of Election Commission to regulate political parties and conduct transparent elections, PTI itself went to the High Court. They should not have been surprised when the appeal was filed.


A 3-member bench headed by Chief Justice of Pakistan Qazi Faiz Isa heard the case directly. Election Commission lawyer Makhdoom Ali Khan and the legal team were present in the court room, PTI Chairman Barrister Gohar Ali Khan, lawyer Hamid Khan, lawyer Shoaib Shaheen, Chief Election Commissioner PTI Niazullah Niazi were also present in the court room. Besides, Ali Zafar was present on video link from Lahore Registry.

At the beginning of the hearing, Election Commission lawyer Makhdoom Ali Khan came to the rostrum. The Chief Justice asked whether the detailed decision of the Peshawar High Court has come? On which PTI's lawyer Hamid Khan replied to the court that the detailed decision has not come yet.


Later, Makhdoom Ali Khan read out the decision to return the bat sign, after which PTI's lawyer Hamid Khan took the stand that we had not received any notice. The Chief Justice remarked that I have not even read the file of the case, he asked Hamid Khan when will you be ready for the case?


To which PTI's lawyer replied that the hearing should be held on Monday. Vakil Election Commission said that election symbols are to be allotted to the candidates tomorrow. The Chief Justice of Pakistan said that the order of Peshawar High Court will have to be suspended to postpone the hearing till Monday, we are ready for the hearing on Saturday and Sunday as well. Makhdoom Ali Khan, the lawyer of the Election Commission, took the position in the court that the previous party elections of Tehreek-e-Insaf were held in 2017. According to the party constitution, Tehreek-e-Insaf was bound to hold party elections in 2022. Notice issued to PTI.
